Service Agreement for My Splitly Users

Introduction

My Splitly provides an online platform intended solely as a communal accounting and record-keeping tool for tracking shared expenditures among associated parties, such as friends, family members, colleagues or informal groups.

All financial records, including bills, expense entries, balances, debt summaries and payment notes displayed on the My Splitly platform are for informal reference purposes only. These records do not create, evidence or constitute any legally enforceable obligation, debt, contract or liability under Indian law.

The My Splitly service is provided on an “as-is” and “as-available” basis, without warranties of any kind. As the platform is under continuous development, certain features of the website or mobile applications may not operate as intended at all times. My Splitly reserves the right to modify, suspend, restrict or discontinue any service or feature at any time without prior notice.

My Splitly may revise this Service Agreement and the Privacy Policy periodically. The latest version shall be made available on the official My Splitly website or application and continued use constitutes acceptance of the revised terms.

Eligibility for Use

Use of the Platform is subject to your acceptance of this Agreement and the Privacy Policy. You may not use the Platform if:

• You are prohibited under applicable Indian law from receiving such services
• Your account has been previously suspended or terminated for violations
• You are below thirteen (13) years of age

If you are under eighteen (18) years of age, you confirm that you are using the Platform with the consent and supervision of a parent or legal guardian.

Service Description

My Splitly (the “Platform”) allows users to record and view non-binding shared expenses, informal balances and payment notes. The Platform performs automated calculations and stores user-submitted information for convenience purposes only. The Platform does not verify, authenticate, validate or guarantee the accuracy or completeness of any information entered by users.

Nature of Obligations

Entries recorded on the Platform are not legally enforceable, do not constitute proof of debt or liability, and represent informal financial communication only. Users acknowledge that My Splitly does not guarantee accuracy and is not responsible for disputes arising between users.

Permitted Use and Compliance

You agree to use the Platform only for lawful purposes and in compliance with applicable Indian laws. You shall not use the Platform for fraud, harassment, defamation, money laundering, unlawful activities or misuse of data. My Splitly reserves the right to suspend or terminate access to comply with legal or governmental requirements.

User Representations

You represent and warrant that all information provided is true, accurate and current, that you have the legal capacity and authority to accept these terms and that you will comply with all applicable laws.

Disclaimer of Warranties

To the maximum extent permitted under Indian law, My Splitly disclaims all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, accuracy, reliability or non-infringement. Use of the Platform is entirely at your own risk.

Account Suspension and Termination

My Splitly may suspend or terminate your account at its sole discretion, with or without notice, including for violations of this Agreement or applicable laws.

User-Generated Content

Users may submit content such as notes, comments, images or expense details. Users remain solely responsible for all content submitted. My Splitly does not monitor or verify content and is not liable for user-generated material. Content may be removed at My Splitly’s discretion.

Content Guidelines

• Violate privacy or harass individuals
• Contain false or misleading information
• Be obscene, abusive or offensive
• Promote violence, hatred or illegal activities
• Constitute spam or fraud
• Create risk or liability for users or My Splitly

Data Protection & Privacy

Personal data is collected and processed in accordance with applicable laws. By using the Platform, you provide free, informed, specific, unconditional and unambiguous consent for processing your personal data. Users may request access, correction, erasure or withdraw consent. Withdrawal of consent may result in limited or terminated access. Data may be disclosed if required by law, court order or government authority.

Grievance Redressal Officer

Grievances may be submitted to: info@mysplitly.com. Complaints will be acknowledged within 24 hours and resolved within 15 days, where reasonably possible.

Limitation of Liability & Indemnification

To the fullest extent permitted by Indian law, My Splitly shall not be liable for any indirect, incidental, consequential, special or punitive damages. You agree to indemnify and hold harmless My Splitly, its directors, employees and agents from any claims, damages, losses or legal expenses arising from your use of the Platform or violation of this Agreement.

Platform Role & Email Communications

My Splitly is strictly a record-keeping and calculation tool. It does not provide payment services, digital wallets, escrow or money transfer facilities. All monetary transactions occur independently outside the Platform. My Splitly may send account alerts and one-time passwords via email. Message frequency may vary. You may opt out by updating account settings or contacting info@mysplitly.com.
